Michigan-based Indian American Doctor to Pay $775,000 to Settle False Claims Act Allegations

An Indian American gynecologic oncologist has agreed to pay $775,000 to resolve claims that he violated the False Claims Act. Vinay K. Malviya “agreed to submitting or causing the submission of false claims for payment to federal health care programs related to alleged medically unnecessary surgical procedures that he performed,” according to the Department of Justice.

In a settlement announced on April 14 by the Department of Justice, the Michigan-based physician “knowingly submitted false claims for payment to federal healthcare programs.” The claims, submitted from Feb. 1, 2011 to June 30, 2017, related to radical hysterectomies and modified radical hysterectomies, chemotherapy services, and “evaluation and management services that were not performed or not rendered as represented,” the DoJ said.

Last August, Ascension Michigan and related hospitals agreed to $2.8 million to resolve claims that they violated the False Claims Act by submitting or causing the submission of false claims for payment to federal health care programs related to alleged medically unnecessary procedures performed by Malviya.

As part of the settlement, “Malviya agreed to be excluded from Medicare, Medicaid and all other federal health care programs for a period of three years. During that time, federal health care programs will not pay anyone for items or services, including administrative and management services, furnished, ordered, or prescribed by him in any capacity, the DoJ said.

The civil settlement includes the resolution of claims brought by Pamela Satchwell, Dawn Kasdorf and Bethany Silva-Gomez under the qui tam or whistleblower provisions of the False Claims Act, the DoJ said.
